Guardians must keep the dog on a leash when outside unless the dog is in the fenced area or directly supervised. Guardian Family must ensure the guardian dog is well socialized to adults, children and other friendly and healthy dogs. Guardian Family must maintain Guardian dog at proper healthy weight and provide regular daily mental and physical exercise. Guardians must communicate any abnormal health or behavior to us immediately. Guardian dogs must be fed and provided a high quality diet from Paw Tree. Transfer of Ownership: Proven Breeder When Breeder, in its sole and absolute discretion, determines that the dog shall no longer be used for breeding purposes, Breeder shall transfer ownership to Guardian at no cost to Guardian. In such circumstances, Guardian must immediately notify Breeder and provide a detailed, written statement of the circumstances that render future performance impossible. If Breeder does take possession of the dog pursuant to this section, Guardian will not be entitled to any compensation from Breeder nor be obligated for any future care of the dog but shall not be absolved or released from any past violations of this Agreement nor damages sustained by Breeder as a result thereof. Neither party may assign, transfer, or subcontract any obligations or rights under this Agreement without the prior written consent of the other party. No changes, modifications or waivers to this Agreement will be effective unless in writing and signed by both parties. In the event that any provision of this Agreement is determined to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Insufficient Care. Buyer agrees that it will not surrender the Puppy to a shelter and that it will not sell, give, or release the Puppy to an individual or family, pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility. Additionally, Buyer agrees that it will not euthanize the Puppy under any circumstances without prior written consent of Seller and instead will return to Seller. If the Puppy is returned within the first thirty 30 days, only half of the Purchase Price will be refunded after the Puppy has been placed in its new home. If the Puppy is returned after the thirty 30 days no money will be refunded to the Buyer. The Buyer pays for all travel expenses back to Seller. Puppy mouthing and biting is a normal stage of puppy development and will not be considered justifiable cause for return of the Puppy. Additionally, temperament behavioral issues will not be considered justifiable cause for return of the Puppy; unless proof of regular obedience training by a certified professional trainer is provided and the Puppy is under four 4 months of age at the time of return. Imperfect puppy bites in pet quality puppies can and do happen. This is typically resolved once puppy baby teeth fall out and adult teeth come in. Condition at Delivery. Seller takes reasonable measures to provide Buyer with a happy, healthy, thriving Puppy. Non-Transferability of Health Guarantee. Any transfer or assignment of this Health Guarantee is void. Visits to Veterinarians. The puppy will not be taken to places other dogs frequent, such as pet stores, dog parks, kennels, grooming salons, etc. Companion Purpose; Mandatory Spaying or Neutering. This Puppy is being sold as a companion pet only and is fit for this purpose only, NOT for breeding purposes. If this Puppy is being sold as a breeding dog, a separate contract and price apply. This Agreement will be constructed in accordance with the laws of Texas. If any legal action is to be taken by either Buyer or Seller, the venue shall be in Texas. Adult size, conformation, coat quality, color and pattern of the Puppy are not guaranteed by Seller. It is understood that no warranty or representation has been made regarding this Puppy except as set forth in writing in this Agreement. It is further agreed that the Puppy is of pet quality for the expressed purpose of a companion pet. In the event, the Seller stops breeding, no replacement puppies shall be given, and any obligations of providing a replacement puppy is limited by the supply of available puppies that Seller has on hand at any given time. Annual Vaccinations and Protective Medications. Buyer guarantees that upon receiving the Puppy, Buyer will keep the Puppy in good health with yearly vaccinations, heartworm protection, and any other necessary procedures to ensure the good health of the Puppy. Governing Law and Venue. This Agreement shall be governed by, and construed, enforced and interpreted in accordance with, the substantive laws without regard to its conflicts of laws provisions of the State of Texas. The parties hereto irrevocably submit to the jurisdiction and venue of any state or federal court sitting in Harris County, Texas over any suit, action or proceeding arising out of or relating to this Agreement. Our breeding stock dogs are own by us and include females of our breeding program and direct German SV import. They healthy, beautiful and smart. We only use pure Show-line bloodlines and our dogs are proven on a Show ring and Working field. All dogs live in our home, along with children, farm animals, and family and friends visiting often. We take great care of our dogs; they are fed nutritious diet , have regular vet visits , are given vitamins and supplements and are truly loved. We have reservations and waiting lists for each litter. All litters are whelped in our warm home. We stay with the female during the entire time of whelping and closely observe to make sure she gets help immediately if needed. Once pups are born, we let momma clean them, bound and have each pup latch on her nipple. We measure each puppy's weight at birth and record time of birth. Pups spend their first weeks in the whelping box, and we keep monitoring their growth closely. Measure their weight and taking pictures daily. By this time many are already sold, have their names picked, and owners are waiting for them eagerly. All pups come with a full veterinary exam, first set of vaccinations and deworming done by a breeder at least three times. We supply their puppy record as a fun keepsake.
